Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Policy”) supplements the information in the LifeDNA Privacy Policy.
It applies solely to Washington consumers who interact with us in an individual or household capacity and applies only to personal information defined as “consumer health data” under the Washington My Health My Data Act. Capitalized terms that are not defined here have the same meaning as in the LifeDNA Privacy Policy. This Policy describes what consumer health data we collect, how we collect and use it, who we disclose it to and why, and the choices you may have regarding our use or disclosure of your consumer health data.
Categories of Consumer Health Data We Collect
We may collect or receive the categories of consumer health data listed below.
- Health and wellness information submitted as part of your account or;
- Survey and questionnaire responses you submit, including, but not limited to information about your demographics and health, if you choose to share such information
- Fitness and Wellness Data:
- Dietary habits and dietary restrictions;
- Lifestyle information, such as sleep habits, fitness activity and life events;
- Body measurements (e.g., height and weight) and other measurements related to physiological condition;
- Health, wellness and other data collected by Nu Skin devices and their associated apps and information that you self-report associated with those devices;
- Profile Information that includes health data: such as demographic information, age, gender, image or photo, etc. from your account profile, which we may combine with any personal information or other data we have collected; and
- Other similar information, as may be requested by us specific to the relevant products or services you engage with.
Information You Provide to Us.
The information we collect on or through our Services may include:
- Information that you provide by filling in forms in our Services. This includes information provided at the time of registering to use our Services, subscribing to our service, posting material, or requesting further services by email or through our customer services.
- Information related to participating in our Research Program.
- When you provide the saliva sample for us to perform services, we may ask you for information relevant to provide your genetic report.
- Survey information [such as your sex, age, ethnicity, weight, and height that a user may provide when responding to a survey. This also includes behavioral and social information such as a user’s occupation, commute, diet, alcohol consumption and tobacco use, fitness and exercise and sleep behavior.]
- We may collect information if you enter a contest or promotion sponsored by us, and when you report a problem with our Services.
- Records and copies of your correspondence (including email addresses) if you contact us.
- Your responses to surveys that we might ask you to complete so we can improve our Services.
- Details of transactions you carry out through our Services and of the fulfillment of your orders. You may be required to provide financial information (i.e., credit card information) before placing an order through our Services.
- Your search queries in the Services.
Information We Collect about You and How We Collect It
We collect several types of information from and about users of our Services, including information:
- By which you may be personally identified, such as name, postal address, e-mail address, telephone number, date of birth, sex, or any other identifier by which you may be contacted online or offline (“personal information“);
- That includes your genotype, diseases or other traits or characteristics, genetic data, and reports we generate from testing the saliva kit.
- That you provide on the test tube that contains your saliva (such as your year of birth and sex).
- Relevant information you provide may include information such as any disease conditions, health-related information, traits, ethnicity, family history, or anything else you provide to us.
Categories of Sources From Which We Collect Consumer Health Data
We may obtain consumer health data from different sources, as described in the LifeDNA Privacy Policy. This includes consumer health data obtained:
- Directly from you when you provide it to us.
- From third parties. For example, we may receive your information from someone who has given you the gift of our product and service.
Purposes for Collecting Your Consumer Health Data
We may collect and use consumer health data for one or more of the following purposes:
- To present our Services and its contents to you.
- To perform services (i.e., analyze your genetic information so we can provide you a report regarding your genotype).
- To sign up for our services by creating an account.
- To fulfill any other purpose for which you provide it.
- To provide you with information, products, or services that you request from us.
- To provide you with notices about your account, including expiration and renewal notices.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- To notify you about changes to our Services or any products or services we offer or provide though it.
- To allow you to participate in interactive features in our Services.
- For research purposes. See Research Program.
- To give us feedback or contact us.
- In any other way we may describe when you provide the information.
- For any other purpose with your consent.
Sharing of Consumer Health Data
We may share each of the categories of consumer health data described above. In particular, we may share personal data, including consumer health data, with your consent, to complete transactions or provide products or services you have requested, and for the purposes described in this Policy. We may share your consumer health data with our affiliates and other representatives if you have provided your consent for such sharing and for the purpose of providing products, services and recommendations to you.
We may also share consumer health data with business partners such as those providing technology, marketing services, governmental agencies and legal bodies, and purchasers of or successors to our business or assets.
Your Washington Consumer Health Data Rights
Washington residents have the right to (1) request access to their consumer health data; (2) confirm whether we have disclosed or sold their consumer health data; (3) delete their consumer health data; or (4) withdraw their consent or authorization relating to such data. To appeal our decision on your Washington Consumer Health Data Rights request, you may contact us by using the contact information listed below or emailing us at [email protected]. In submitting your appeal, please enclose a copy of or otherwise specifically reference our decision on your data subject request, so that we may adequately review and address it. We will respond in accordance with applicable law.
